I am addressing these topics for multiple reasons. First, when the matter is an emergency it can be greatly expedited. The Court will likely sign an “Order Shortening Time” and your initial hearing will often be held within a few days. I will be addressing the process of gaining an expedited hearing. Second, gaining emergency custody requires that you provide proof that the situation is actually urgent. I will be discussing what the Court considers an emergency and will also address the type of documentation and evidence which Courts may wish to see. Third, while an initial hearing can be had within a few days, it is important that gaining a final order can take some time. I will be discussing the process of doing so.
An important point that I will be making is that you should contact an attorney immediately if you believe that your son or daughter is in danger. If you take the matter into your own hands then you will be considered in violation of a Court Order. This can greatly hurt your chances of gaining custody.
