It is important to remember that a Judge’s concern will always be based on the best interest of the child. If a Judge believes that a parent’s legal use of weed is endangering a child, or otherwise impacting their parenting, the Court may modify the current custody order. Las Vegas judges will likely have little patience for a parent who smokes marijuana in the presence of the child
It is true that recreational marijuana is now legal in Nevada. Due to this, some believe that smoking marijuana in the presence of a child is no different than having a glass of wine while they are present. This is not the case, however, as marijuana has “second hand” effects which are not present with alcohol. Given that a child can be directly impacted by a parent smoking in their presence, the Court would likely have little patience with a parent who engages in this conduct. While not a perfect analogy, one could argue it would be akin to taking an underage child into a bar. Even if the child was not drinking, the problems with such conduct would be obvious. In short, a Judge would likely take action against a parent who smokes marijuana in the presence of their youth.
The discussion becomes different if a parent is consuming edible marijuana products in the presence of a child. Given that the risk of a “contact high,” and the problems that come with odors, have gone away, a judge is likely to be more forgiving in such a situation. Eating a marijuana laced cookie at night, when the family is in for the night, is likely to be seen as akin to having a glass of wine in the presence of the child. If the situation is one where the parent is not going to need to drive for the rest of the evening, then a Las Vegas Judge may be less concerned about the situation. Again, the outcome of any case will be fact specific.
