This post is written to conclude and recap my series on the handling of Las Vegas, Nevada child custody cases in which a teenager has been given “discretion” as to which parent they will spend time with. I felt it necessary to write on this issue due to the fact that the idea of a child having such power can cause great anxiety for a parent. A dad may also be unsure as to how they should proceed when disputes arise. The goal of my recent articles was to provide information which will help people to more fully understand their options. It has also been my goal to provide information which will assist with the selection of a fathers’ rights attorney. I have addressed a number of topics over my recent articles. The issues which I have analyzed include:
- When Family Courts will consider the wishes of a teenage child
- When the Court may grant a teenage child “discretion” as to who they will spend their time with
- How parental coaching can impact a teenager’s discretion
I chose to address these topics for multiple reasons. First, many parents make the mistake of thinking that there is a certain age at which the child will simply choose whom they wish to live with. This belief is incorrect. The wishes of the child are just one factor which the Court will consider. The extent to which a Judge will consider those wishes will depend on the child’s age and maturity. Second, a Court will typically only grant a child “discretion” if the parents can agree on such an arrangement. Finally, if a parent is abusing such an arrangement then the Court may very well rescind it and modify custody in favor of the other parent.
An issue I stressed through each of these articles is the need to contact an experienced family law attorney as soon as possible if you are experiencing issues which involve your teenager. By contacting counsel sooner, rather than later, you help to ensure that your matter is handled correctly. As a Las Vegas fathers’ rights lawyer, I devote my practice to the handling of family law.
