I chose to address these topics for multiple reasons. First, many parents make the mistake of thinking that there is a certain age at which the child will simply choose whom they wish to live with. This belief is incorrect. The wishes of the child are just one factor which the Court will consider. The extent to which a Judge will consider those wishes will depend on the child’s age and maturity. Second, a Court will typically only grant a child “discretion” if the parents can agree on such an arrangement. Finally, if a parent is abusing such an arrangement then the Court may very well rescind it and modify custody in favor of the other parent.
